The law specifically provides that this information shall be made available to all persons currently residing within the District and to all prospective District residents. The following information describing the Capital Region Community Development District and the assessments, fees and charges that have been levied within the District to pay for certain community infrastructure is provided to fulfill this statutory requirement. What is the District and how is it governed? The District is an independent special taxing district, created pursuant to and existing under the provisions of Chapter 190, Florida Statutes, and established by Rule 42CC-l, Florida Administrative Code, adopted by the Florida Land & Water Adjudicatory Commission, effective February 28, 2000, and amended November 1, 2006. The District currently encompasses approximately .3,287 acres of land located entirely within the jurisdictional boundaries of the City of Tallahassee, Florida, and Leon County, Florida. As a local unit of special-purpose government, the District provides an alternative means for planning, financing, constructing, operating and maintaining various public improvements and community facilities within its jurisdiction. The District is governed by a five (5) member Board of Supervisors, the members of which must be residents of the State and citizens of the United States. Within ninety (90) days of appointment of the initial board, members were elected on an at-large basis by the owners of property within the District, each landowner being entitled to one (1) vote for each acre of land with fractions thereof rounded upward to the nearest whole number. Thereafter, elections are held every two (2) years in November, beginning in November of 2002. Commencing in November 2006, the positions of two (2) board members whose terms were expiring were filled by qualified electors of the district.2 The remaining board member whose term expired was selected by the landowners and was not required to be a qualified elector. Thereafter, as terms expire, board members shall be qualified electors elected by qualified electors of the district for a term of four (4) years. A "qualified elector" in this instance is any person at least eighteen (18) years of age who is a citizen of the United States, a legal resident of Florida and of the District, and who is also registered with the Supervisor of Elections to vote in Leon County. Notwithstanding the foregoing, if at any time the Board proposes to exercise its ad valorem taxing power, it shall, prior to the exercise of such power, call an election at which all members of the Board shall be elected by qualified electors of the District. 2The members of the Board elected by qualified electors of the District in November 2006 were Alan Hanstein and Mary Lee Kiracofe. 1 Board meetings are noticed in the local newspaper, the Tallahassee Democrat, and are conducted in a public forum in which public participation is permitted. Consistent with Florida's public records laws, the records of the District are available for public inspection during normal business hours. Elected members of the Board are similarly bound by the State's open meetings law and are subject to the same disclosure requirements as other elected officials under the State's ethics laws. What infrastructure improvements does the District provide and how are the improvements paid for? The District is comprised of approximately 3,287 acres. The legal description of the District is attached hereto as Exhibit A The public infrastructure necessary to support the Capital Region development program includes, but is not limited to, the following: on and off-site roadways, stormwater management facilities, open space and recreational improvements, entrance features and landscape improvements, roadway signage, street lighting and subdivision infrastructure improvements. Each of these infrastructure improvements is more fully detailed below. These public infrastructure improvements have been or will be funded in part by the District's sale of bonds. On October 26, 2000, the Circuit Court of the Second Judicial Circuit of the State of Florida, in and for Leon County, Florida, entered a Final Judgment validating the District's ability to issue up to $275,000,000.00 in Capital Improvement Revenue Bonds for infrastructure needs of the District The Final Judgment acknowledges that for the infrastructure contemplated by the Improvement Plan to be constructed, $275,000,000.00 may need to be expended. On March 1, 2001, the District issued its first series of bonds to begin financing the infrastructure improvements. The District issued Series 200IA Capital Improvement Revenue Bonds in the amount of $10, 130,000 and Series 200IB Capital Improvement Revenue Bonds in the amount of $11 ,240,000 (collectively, "Series 2001 Bonds"). On March 1,2002, the District issued itsSeries 2002A CapitalImprovementRevenueBonds intheamount of$1.3,410,000("Series2002A Bonds"). On June 6, 2003, the District issued its Series 200.3B Capital Improvement Revenue Bonds in the amount of $10,000,000 ("Series 2003B Bonds"). On December 15, 2004, the District closed on the sale of its Series 2004 Bond Anticipation Notes in the amount of $10,000,000 ("Series 2004 Notes"). On November 4,2005, the District closed on the sale of its Series 2005 Bond Anticipation Notesintheamount of$10,000,000("Series2005Notes"). Finally,onMarch14,2006,theDistrict closed on the sale of its Series 2006 Bond Anticipation Notes in the amount of$10,000,000 ("Series 2006 Notes"). Proceeds of the Series 2001, 2002A and 2003B Bonds and Series 2004, 2005 and 2006 Notes are and will be used to finance a portion of the cost of the acquisition, construction, installation and equipping of the infrastructure and improvements. The District intends to issue additionalseries ofbondsorbondanticipationnotesinthefuture tofurther financetheinfrastructure improvements. 2 To plan the infrastructure improvements necessary for the District, the District adopted an Improvement Plan and a subsequent amendment ("Improvement Plan") that details all of the improvements contemplated for the completion of the infrastructure of the Capital Region CDD. A copy of the District's Improvement Plan is available for review at the office of the District Manager and in the District's local files at the offices of the County Administrator, 301 South Monroe Street, Tallahassee, Florida 32301. Additionally, for certain series of bonds and notes issued by the District, a separate engineering report was created and adopted by the Board of Supervisors that details the precise improvements contemplated by the particular series of bonds and notes at issue. For the Series 2001 Bonds, the Engineering Report for Series 2001 Capital Improvements ("Series 2001 Engineering Report") dated March 2001, was adopted by the Board. For the Series 2002A Bonds, the Board adopted the Engineering Report for Series 2002 Capital Improvements dated March 21, 2002 1 ("Series 2002 Engineering Report"), For the Series 2003B Bonds, the Board adopted the Engineering Report for Series 2003 Capital Improvements dated June 5, 2003 ("Series 2003B Engineering Report"). For the Series 2004 Notes, the Board adopted the Engineering Report for the Series 2004 Capital Improvements dated October 27, 20042 ("Series 2004 Engineering Report"). The Series 2005 and Series 2006 Notes do not have an accompanying engineering report. Rather, the Series 2005 and Series 2006 Notes will be used to fund any projects included in the District's adopted Improvement Plan. Copies of the Series 2001 Engineering Report, Series 2002 Engineering Report, Series 2003B Engineering Report and Series 2004 Engineering Report are also available for review at the office of the District Manager and in the District's local files in Tallahassee. On-Site Roadway Improvements The District will provide for the construction and acquisition of several roadways within the District boundaries. These improvements allow access to District properties and provide necessary traffic volume capacity. The District also intends to construct interior roads throughout all phases of construction. Certain public roadway systems constructed or acquired by Capital Region Community Development District will be ultimately owned and maintained by the City of Tallahassee, Florida. Finally, the District may undertake other roadway improvements as approved by the Board of Supervisors. 1 The Series 2002 Engineering Report was subsequently amended on July 7, 2005, to modify the Series 2002 improvements to include any projects contemplated in the Adopted Improvement Plan, as long as there are funds from the Series 2002 Bonds to fund such projects, These additional projects include roadways, off-site roadways, subdivision infrastructure, landscape and irrigation and pedestrian trails and park furniture, The additional project costs will also include the associated engineering costs, legal fees, and permit fees and expenses. 2 The Series 2004 Engineering Report was subsequently amended on July 7, 2005. Additional on-site roadway improvements to be constructed and acquired by the District are described in the Series 2002 Engineering Report and include Esplanade Way (Drayton Drive to Blairstone Road), Blairstone Road (Capital Circle to Esplanade Way), Merchant's Row Boulevard (Four Oaks Boulevard to Colleton Court), Four Oaks Boulevard (Merchants Row to Shumard Oaks), Ivy Green, Colleton Court, Riverton Drive, Grove Park Drive (Mossy Creek Lane to Hemingway Boulevard), Grove Park Drive (Colleton Court to Shumard Oak), Biltmore Avenue (Carrolton to Tremont) and Hemingway Boulevard (Grove Park Drive to Southwood Plantation). The Series 2003 Engineering Report provides for the design and/or construction of certain roadways, including Blairstone Road (Esplanade Way to Four Oaks Blvd.), Esplanade Way (Blairstone Road to 1,350 feet North), Ivy Green (Merchants Row to Grove Park Drive), Four Oaks Blvd. (TC-l to LDR-6), Grove Park Drive (Hemingway Blvd. To Terrebone Road), Biltmore Avenue (Unit 2 Phase 3), and Hemingway Blvd. (Unit 2 Phase 3). The Series 2004 Engineering Report provides for numerous on-site roadway projects including design Orange Avenue (Capital Circle SE to Biltmore Avenue), design Merchant's Row (Capital Circle SE to Paul Russell Road), design Esplanade Way (LDR-7 to Orange Avenue), design Four Oaks Blvd. (Unit 18 to Orange Avenue), design Mossy Creek (Unit 19 to Orange Avenue), design Biltmore Avenue (Unit 25 to Orange Avenue), design Shumard Oak (4 lane at Four Oaks Blvd.), construct Grove Park Drive (Colleton to Alcott), construct Biltmore Avenue (Tremont to Unit 25), construct Shumard Oak (four lane at Four Oaks Blvd.), design Four Oaks Blvd. (Four lane at Shumard Oak), design Paul Russell Road (Tram Road to Capital Circle), construct Biltmore Avenue (next to Unit 16), and design Biltmore Avenue (Tremont to Unit 25). As the District has issued additional bonds or bond anticipation notes, more of the roadways contemplated in the Improvement Plan have been and will be constructed. Orr-Site Roadway Improvements The Southwood Development of Regional Impact Development Order requires the construction of certain off-site roadway improvements within time parameters set by the Development Order. The District has commenced a construction program to comply with these requirements. 4 The purpose of the off-site roadway improvements is to mitigate the traffic impacts which are anticipated due to the development within the Capital Region Community Development District. The off-site roadway improvements consist primarily of road widening, road extension, creation of exclusive turning lanes, and installation of traffic signals. Certain public roadway systems constructed or acquired by Capital Region Community Development District will be ultimately owned and maintained by the City of Tallahassee, Florida, except improvements made to public highways, which will continue to be maintained by the State of Florida, A more detailed description of the off-site roadway improvements may be obtained by reviewing the District's Engineering Reports and Improvement Plan on file in the District's public records. Stormwater Management Facilities The District will provide for the design and construction of stormwater management facilities necessary to support the infrastructure improvements, inclusive of conveyance channels, lakes, ponds, storage and attenuation facilities, control structures, culverts and pipe systems, discharge structures, wetland maintenance, altered wetlands, and littoral shelves. In addition, the stormwater management facilities include all other improvements coincident with stormwater management systems. More specific information regarding the stormwater management system and related improvements may be found in the Stormwater Facilities Masterplan which is part of the public records maintained at the District Office. Open Space and Recreational Improvements Open Space and Recreation Improvements will be designed to meet the needs of the District's residents. The proposed parks are passive in that the improvements call for minimal landscaping and irrigation, benches, trails, and minimal lighting and trash receptacles. The Series 2001 Engineering Report provides for the construction of approximately 14,000 linear feet of trails with two trail bridges. The Series 2002 Engineering Report provides for the construction of an additional 16,000 linear feet of trails and one additional trail bridge, Entrance Features and Landscape Improvements There are five (5) project entrances to the Capital Region Community Development District. For each of the five (5) entrances, the District will construct and maintain certain features and landscaping lighting. According to the Improvement Plan, the five entrances for which landscape improvements will be constructed are at the intersections of Capital Circle and Blair Stone Road, Capital Circle and Merchants Row Boulevard, Capital Circle and Orange Avenue, Four Oaks Boulevard and Tram Road, and Old St. Augustine Road and Biltmore Avenue. The Series 2003 Engineering Report provides for the construction of entrance features and landscape improvements at Blairstone Road and Capital Circle. 5 Internal Collector Roads and Streetscape Those collector roads constructed by the District with a 60ft to 80ft right-of-way, and wider at certain median areas, will have certain landscape and signage improvements. Further information regarding any oftheplannedlandscape andsignage improvementscanbeobtainedfromtheDistrict's Engineering Reports on file in the District's public records. Subdivision Infrastructure Improvements In addition to the improvements noted above, the District will make certain infrastructure improvements within the subdivision as development progresses. The Series 2002 Engineering Report provides for the engineering and application for permit for the following projects: LDR-IO and TC-2 East. The Series 2003 Engineering Report provides for facilities for each parcel of development to include roads, alleys, lighting, storm sewers, stormwater facilities, parks and landscaping for the following projects: Unit 2 Phase.3 (Alley One); TC-2 West; LDR-II; LSF-lO; MDR-8; LSF-5; and LDR-l2. Additionally, the Series 2004 Engineering Report provides for facilities for each parcel of development to include roads, alleys, lighting, storm sewers, stormwater facilities, parks and landscaping for the following projects: LDR-15/LSF-9 (Unit 2); LDR-6 (Unit 18); design Unit 2.3; design LDR-1.3/LSF-7 (south of out-parcel). Further information regarding any of the planned improvements can be obtained from the District's Engineering Reports on file in the District's public records. Assessments. Fees, and Charges As noted above, the District anticipates issuing bonds as a method of financing the infrastructure improvement needs of the Capital Region CDD. The Series 200 I Bonds, Series 2002A Bonds, Series 200.3B Bonds, Series 2005 and Series 2006 Notes', along with the interest due thereon, are payable solely from and secured by the levy of non ad valorem or special assessments against lands within the District that benefit from the construction, acquisition, establishment and operation of the District's improvements. The assessments are typically billed in the same manner as are county ad valorem taxes but may be billed directly by the District. A breakdown of the capital assessments are attached as Exhibit B. The Developer may choose to contribute funds in a manner that would reduce the actual assessment amounts shown on Exhibit B. The amounts described above exclude any operations and maintenance assessments that are calculated annually by the District's Board of Supervisors against all benefitted lands in the District. 3The Series 2004 Notes were repaid in full by The St. Joe Company on October 26,2007. 6 A breakdown of the current operations and maintenance assessments are also delineated in Exhibit B. As is true with the capital assessments, the Developer may choose to contribute funds or provide services in a manner that would reduce the actual operations and maintenance assessment amounts shown on Exhibit B. The operations and maintenance assessments are in addition to the capital assessments, as shown on Exhibit B for each product type. A detailed description of all costs and allocations that result in the formulation of assessments, fees and charges are available for public inspection upon request.
